General Terms and Conditions of Business and Delivery
1. offers
Our offers are subject to change without notice both with regard to the pricing and the technical details of the products offered, unless they are expressly designated as binding. This also applies to service offers.
2. orders
By placing a written order, the client/buyer accepts our general terms and conditions of business and delivery. Deviating agreements as well as any different terms and conditions of the client/buyer require our prior written consent. Orders from the client/buyer must be in writing (post/fax/e-mail). Orders shall only be processed if the client accepts the terms and conditions of business, payment and delivery set out in the order confirmation and acquires the equipment ordered for the purpose of achieving his freelance or self-employed activity and is therefore not a consumer within the meaning of the law. By sending an order, the client assures that he is not a consumer within the meaning of the law. This also applies to service orders.
3. prices
Our sales prices stated on the Internet as well as all list prices or transfer prices are subject to change without notice. All prices are ex warehouse JeCoNet (Incoterms 2000 EXW) and do not include any costs for, among other things, packaging, transport, transport insurance, handling of customs formalities as well as for dismantling or installation or commissioning of the equipment. All our prices are net prices plus the statutory value added tax applicable at the time of dispatch, collection or invoicing.
4. terms of delivery, order execution
Unless otherwise agreed, all used equipment offered by us is subject to collection from the JeCoNet warehouse against payment of the purchase price in cash or by advance payment after prior bank transfer. If the buyer wishes a delivery, JeCoNet will submit an offer for this in advance (for the packaging, the transport costs, a transport insurance as well as, if applicable, the handling of customs formalities, etc.). All deliveries within Germany and Europe are generally made according to Incoterms 2000 CIP (Cost Insurance Paid). To all other countries, EXW warehouse location JeCoNet applies as a matter of principle.
For online enquiries the following prices apply within Germany (only parcels with a max. edge length of 175 cm and a girth of max. 300 cm) for delivery incl. packaging and transport insurance up to a net goods value of 500,-- Euro:

In case of a higher value of goods than 500,-- Euro the price for the higher insurance up to a value of goods of 1020,-- Euro is an additional 10,-- Euro net and for each further 500,-- Euro value of goods or part thereof an additional 2,50,-- Euro net. All goods are only insured up to the full value of the goods. Unless the buyer waives this in writing by fully assuming the risk of damage or loss.
The buyer undertakes to check all deliveries upon receipt by the respective carrier for intactness or possible transport damage. The buyer must have any transport damage acknowledged by the driver on the delivery receipt. The assertion of claims for transport damage not acknowledged upon acceptance is excluded due to the conditions of the carrier and shall therefore be borne by the buyer.
All other countries as well as all deliveries by forwarder on pallet

Deliveries are carried out by a transport company to be determined by JeCoNet. JeCoNet is not responsible for any delays in delivery caused by the transport company. If the buyer does not accept the goods delivered by the transport company, possible costs for a resulting temporary storage as well as further deliveries by the transport company are to be borne by the buyer. These are to be paid by the buyer to the transport company upon acceptance of the goods. We reserve the right to make partial deliveries.
4.a Online enquiries
With the online enquiry via the enquiry form of the platform www.JeCoNet.de the client/buyer bindingly accepts our general terms and conditions of business and delivery. Since it is possible that the product requested by the buyer has already been sold elsewhere, the online enquiry initially only represents a purchase request for JeCoNet. JeCoNet will check the availability of the requested product in a timely manner and send the buyer an order confirmation by e-mail. Only then is the purchase contract concluded. Deviating agreements as well as any different terms and conditions of the client/buyer require our prior written consent. By sending the online enquiry, the buyer assures that he/she is using the products within the scope of his/her freelance or self-employed activity and is therefore not a consumer within the meaning of the law.
5. payments
Unless otherwise agreed, used equipment shall be payable immediately upon collection; in the case of deliveries, advance payment or cash on delivery shall apply as a matter of principle. Invoices are due within 7 days without deduction.
6. default of payment and acceptance as well as cancellations
In the event of default of payment or acceptance on the part of the customer/buyer, we shall be entitled to set the buyer a grace period of 3 days and to withdraw from the contract after the fruitless expiry of this grace period.
In this case, as well as in case of cancellation of an order by the buyer, the buyer has to pay a lump sum cancellation fee of 30 % of the gross purchase price to JeCoNet, unless the buyer proves to JeCoNet that the incurred damage is lower or JeCoNet proves that the incurred damage is higher. If this is proven to be the case, the buyer has to pay the proven damage.
If ordered goods are not collected by the buyer in due time, JeCoNet can have them stored elsewhere at the buyer's expense without setting a grace period. These costs are to be paid by the buyer to the storage company upon collection of the goods.
7. liability/warranty/defects
The devices offered by JeCoNet are used devices. The devices are sold exclusively to freelancers or tradesmen under exclusion of any warranty. Any liability of JeCoNet, especially with regard to defects of any kind occurring on the devices after delivery, possible consequential damages as well as damages resulting from the use or in connection with the use of the devices, is excluded.
It is expressly pointed out to the purchaser that, with regard to the commissioning of the devices purchased from us in the field of human medicine, he must comply with all legal regulations, in particular the regulations of the Medical Devices Act (MPG) and the Medical Devices Operator Ordinance (MPBV), and, if prescribed, must have a corresponding safety inspection (STK) of the device carried out. The purchaser or reseller is solely responsible for compliance with these obligations.
All units delivered by us are checked and tested for function before delivery or a function test (self-test) is carried out. Spare and wear parts are also checked and tested by us before delivery. Any defects in the units known to the seller will be notified to the buyer in the offer and are therefore the subject of the delivery. The period for the assertion of possible complaints on the devices delivered by JeCoNet is two weeks after delivery. Complaints after this period will not be accepted by JeCoNet.
8. retention of title
We reserve the right of ownership of our goods until all liabilities of the buyer resulting from the business relationship have been settled.
9. exchange/return
For all used equipment as well as spare and wear parts an exchange as well as the taking back is excluded.
10. Place of performance and jurisdiction
Place of performance for our deliveries is the respective place of storage. Place of jurisdiction is Velbert.
11. knowledge of these general terms and conditions
As we publish our complete product range exclusively via the Internet, every purchaser has the obligation to take note of the contents of our general terms and conditions of business and delivery here. In all our written offers, reference is made to this obligation. Thus, these General Terms and Conditions of Business and Delivery are an integral part of every concluded purchase contract. Deviating agreements must be made in writing.
